1. Scope

These terms and conditions apply to all contracts, deliveries and services between Fensterheld OG (hereinafter “Fensterheld”) and its customers, unless expressly agreed otherwise.

Any differing terms and conditions of the customer do not form part of the contract unless confirmed in writing by Fensterheld.

2. Services

Fensterheld offers, in particular, the supply and installation of solar control, thermal insulation, UV protection, safety and design films for glass surfaces.

The specific service (product, installation and additional services) is defined in the respective quotation or order.

3. Conclusion of the contract

  1. Our quotations are non-binding.

  2. A contract is concluded only upon written confirmation or actual performance of the service (delivery or installation).

  3. Fensterheld reserves the right to refuse orders without giving reasons.

4. Prices and payment

  1. All prices are stated in euros and include statutory VAT, unless expressly stated otherwise.

  2. The invoice amount is payable immediately upon completion and acceptance, unless a different payment period has been agreed.

  3. Fensterheld is entitled to request a reasonable deposit for larger projects.

  4. Statutory default interest applies in the event of late payment.

5. Delivery and installation

  1. Delivery and installation dates are binding only if confirmed in writing.

  2. The customer must ensure unobstructed access to the surfaces where installation will take place.

  3. Fensterheld is not liable for delays caused by circumstances beyond its control, such as weather or official requirements.

6. Statutory warranty and guarantee

The statutory warranty provisions apply.

All films we offer carry a 10-year manufacturer’s warranty under the respective manufacturer’s terms. The manufacturer’s warranty documents for the relevant product define the warrantor, coverage, conditions and claims procedure. Your statutory warranty rights remain unaffected.

7. Liability

  1. Fensterheld is liable only for damage caused intentionally or through gross negligence.

  2. Liability for slight negligence is excluded, except in cases of damage to life, body or health.

  3. Fensterheld accepts no liability for consequential damage, such as glass breakage resulting from pre-existing damage or incorrect information supplied by the customer, unless otherwise agreed in writing.

8. Right of withdrawal (for consumers)

  1. Customers who are consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from the contract within 14 days without giving reasons.

  2. For paid services, early expiry of withdrawal rights requires full performance. The consumer must have expressly consented beforehand to performance starting and acknowledged, before it starts, that full performance ends that right. Statutory exceptions and mandatory consumer rights remain unaffected.

  3. A clear statement by email or post is sufficient to exercise the right of withdrawal.

9. Data protection

Fensterheld processes personal data exclusively in accordance with statutory provisions. Further information is available in the privacy policy at www.fenster-held.at.

10. Final provisions

  1. Changes or additions to these terms and conditions must be made in writing.

  2. If any individual provision is invalid, the validity of the remaining provisions is unaffected.

  3. Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

  4. To the extent permitted by law, the court with subject-matter jurisdiction at Fensterheld’s registered office in Vienna is the agreed place of jurisdiction. Mandatory statutory jurisdiction and consumer rights remain unaffected.
